1. Acceptance of terms
By downloading, installing or using Stakemate (the “App”) or visiting www.stakemate.com.au (the “Website”), you agree to these Terms. If you don’t agree, don’t use them. We may update the Terms from time to time; if you keep using Stakemate after an update is posted, you accept the updated Terms.
2. Eligibility
You must be at least 18 years old to use Stakemate. You are responsible for complying with the laws that apply to you, including any laws about poker or gambling where you live or play.
3. Accounts and security
You can use parts of the App without an account. To use cloud backup, sync and community features you sign in with Sign in with Apple or Sign in with Google. You are responsible for keeping your Apple or Google account secure and for activity under your Stakemate account. Tell us at support@stakemate.com.au if you suspect unauthorised access. You can delete your account at any time — see Delete Account.
4. What Stakemate is
Stakemate is a poker tracking and community app. It helps you record sessions and results, view statistics, keep notes, browse tournament and cash-game listings, use poker calculators and reference charts, keep home-game records, and connect with other players. Stakemate is not a gambling service. It doesn’t offer real-money games, take bets, or hold or move money between users.
5. Poker information disclaimer
No guarantee of results. Nothing in Stakemate guarantees winnings, profit, improvement or any poker result. Statistics reflect only the data you enter. Calculators, ranges, AI output and other information in the App are provided for information and education only. They aren’t financial, legal, tax or professional advice, and may be wrong or unsuitable for your situation. Poker involves risk of loss. You are solely responsible for your own decisions and for how you use the information.
Tournament and cash-game listings come from a range of sources and may be incomplete, out of date or inaccurate. Check details, times and buy-ins with the venue or organiser before you travel or play.
6. AI Coach and AI tools
Some plans include AI Coach and AI note tools, which analyse the hands or notes you submit and return automated feedback, suggestions and grades. This output is generated by an automated system, processed by a third-party AI provider, and may be inaccurate or incomplete. It is not professional coaching. Don’t submit information that identifies other people without their consent. Plan limits on AI use may apply.
7. Community rules and user content
You keep ownership of the content you post (posts, comments, messages, images, notes and records). You give Stakemate a limited, non-exclusive licence to host, store, display and process that content to run the service and to show it to other users according to your visibility settings.
We have zero tolerance for objectionable content and abusive behaviour, including harassment, hate speech, sexually explicit material, threats or violence, spam, scams, impersonation and illegal content. You must have the right to share what you post, and you must not post other people’s private information.
You can report content or users and block other users from posts, comments, profiles and messages. We review reports and may remove content, restrict features or terminate accounts at our discretion. Content you upload as images may be viewable by anyone with its link — see the Privacy Policy.
8. Staking and home games
Staking. Stakemate lets you list, find and keep records of staking or backing arrangements with other players. This is a coordination and record-keeping tool only — not a marketplace, broker, escrow or payment service. We aren’t a party to, and don’t review or endorse, any arrangement. Money, if any, moves directly between users outside the App and we can’t see whether it happens. It’s your responsibility to check whether an arrangement is lawful where you and the other person are, to vet who you deal with, agree terms, and collect or pay any amounts. We don’t verify anyone’s identity, age, location or ability to pay. To the extent the law allows, we aren’t liable for loss arising from an arrangement between users, and you agree to indemnify Stakemate against claims arising from arrangements you enter.
Home games. The home-game tools record buy-ins, cash-outs, expenses and settlements for games you run. They are a ledger only. Stakemate doesn’t run, host or verify games, collect or pay out money, and isn’t responsible for disputes between players or for complying with laws that apply to hosting a game.
9. Acceptable use
You agree not to: use Stakemate unlawfully; harass or harm others; impersonate anyone; reverse-engineer or copy the App; scrape or republish content without permission; interfere with our servers or security; attempt to access other users’ accounts or data; or abuse or overload AI or other features.
10. Subscriptions and payments
Stakemate is free to download and offers optional Pro and Elite subscriptions that unlock additional features. The features in each plan, and current prices in your currency, are shown in the App before you subscribe. Plan contents may change over time.
- Billing. Subscriptions are purchased and billed through the Apple App Store or Google Play under that store’s terms. Stakemate doesn’t receive your payment card details.
- Free trial. Eligible new subscribers may be offered a 7-day free trial. Trials are offered and managed by Apple or Google, limited to one per Apple ID or Google account, and convert to a paid subscription unless cancelled before the trial ends.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the price shown, unless you cancel at least 24 hours before the renewal date.
- Cancellation. Cancel in your App Store or Google Play subscription settings. You keep access until the end of the period you’ve paid for. Deleting your Stakemate account or the App does not cancel your subscription.
- Refunds. Apple or Google decides refund requests; we can’t issue them on their behalf. Nothing here limits any consumer rights you have under law that can’t be excluded.
11. Termination and account deletion
You can stop using Stakemate or delete your account at any time. We may suspend or terminate your account or access if you breach these Terms, if required by law, or to protect users or the service. If we terminate your account for breach, you aren’t entitled to a refund from us of subscription fees already paid; refunds remain subject to Apple’s or Google’s policies. What is deleted and what may remain after deletion is explained on the Delete Account page and in the Privacy Policy.
12. Intellectual property
The App and Website — including the Stakemate name, logo, design, software and content we create — are owned by us or our licensors and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes. Nothing transfers our intellectual property to you.
13. Third-party services
Stakemate relies on third-party services, including Apple, Google, our hosting and database providers and an AI provider. Their services are governed by their own terms and we aren’t responsible for them. Links to third-party sites are provided for convenience only.
14. Availability and changes
We work to keep Stakemate available and reliable but don’t promise that it will be uninterrupted or error-free. We may add, change, limit or remove features, plans, limits or content, or discontinue the service, at any time. Data stored only on your device is your responsibility; sign in to back it up to the cloud.
15. Warranties and liability
To the fullest extent permitted by law, Stakemate is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, including loss of profits, winnings, data or goodwill, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes or limits any right or remedy you have under the Australian Consumer Law or other law that can’t be excluded.
16. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
